AIT provides you with access to live / online courses, trading products and tools, 1 on 1 or group coaching programs, webinars, workshops, monthly accountability and progress tracking sessions offline at location or online via internet, e-books, discussion groups and communities on other social platforms (incl. Whatsapp, Discord), content on social media channels (Instagram, Facebook, Youtube, Linkedin, Twitter, TikTok, Discord, Threads etc), tools and materials for marketing, educational and informational purposes only (collectively, including any new features, the “Service”) through our website located at domains www.instituteoftrading.net, www.ait.amsterdam - including any sub-domains therein, such as store.[domain] and video.[domain] , or hosted on 3rd party platforms -  such as whop.com or mee6.xyz ( collectively the “Site”), subject to the terms of service herein (the “Terms and Conditions”) , which also comprises the "Risk and Legal Disclaimer" (available at www.instituteoftrading.net/disclaimer

Every student, customer, registered user, visitor acknowledges that he/she has read, understood and agreed to abide the full Terms and Conditions (as outlined below).


1. Student Warranties & Requirements

a. The student warrants that all documents and information supplied are true, authentic and correct.

b. In cases where a student has provided incorrect, fraudulent or misleading information, they will be immediately removed from the course and no fees will be refunded.

c. Student Requirements for courses

i. -> A lot of motivation to learn and then to practice on your own time, completing homework assignments

ii.-> We strongly recommend having a second display/monitor connected to your laptop, or 2 displays to your desktop PC during the masterclasses. This to allow an optimal view of the course material but also practicing yourself in the same time with the instructor

iii.-> Microsoft Windows 10 or 11 Operating System is recommended, for best use of the Forex Tester trading simulator

*If you have a MacBook, a solution for that would be to create a virtual machine with Parallels Desktop or VMWare Fusion and install Windows on it. It is your responsibility as student to arrange that prior to the course.

You’ll then be able to use Forex Tester at full strength.

Please note that Forex Tester program isn’t compatible with Play on Mac, VirtualBox on Mac, and Wine.

 

2. Code of Conduct

Students are expected to act in a professional and respectful way with all staff, other students, members of the public and AIT Property. Violations of the student code of conduct may result in severe disciplinary action such as course expulsion. We take this matter very seriously and expect all students to adhere to the standards set forth for conduct within this institute.

 

3. Withdrawal

a. The student agreeas that any changes, deferrals, or withdrawals must be approved by AIT prior to taking effect. If a student fails to participate to their course as scheduled without notifying AIT beforehand, they will be expelled and receive no refund.

b. AIT reserves the right to pursue any outstanding fees from students who have withdrawn from the program without prior consent.

 

4. Exclusion

To the extent permitted by law, we, other members of our group of companies and associated parties exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

 

5. Registration on Course

By registering for a course program, students will become members of AIT and agree to uphold its Code of Conduct (clause 2) and Terms and Conditions of registration.

* By 'lifetime access' to Video Courses, we are referring to the operational lifetime of the current software platform where the course is being hosted. If this platform ceases to function, AIT will make reasonable efforts to migrate content to a new platform, but continuity is not guaranteed. In the unlikely event that the hosting platform will not perform anymore due to cases outside our power, the students might lose access to the course contents.

 

6. Refund Policy - Student Default

a. A student has the right to a full refund, minus a 20% processing fee, when withdrawing from one of our live courses 30 days or more prior to the start of the LIVE program. All refunds will be finalized within 45 days of the initial claim.

b. Students who withdraw from a Live course up to 29 days prior to the start of the program will be entitled to a 50% refund.

c. Students who withdraw after commencing date of the Live course are not eligible to receive a refund. Delegates must make all tuition payments according to the instalment plans outlined in their enrolment form, once they have commenced their program.

d. When a student defers their course, they forfeit their right to obtain a refund. Likewise, when a student fails or tries to withdraw from the deferred course, refunds may not be issued except in extraordinary cases. The Refunds Committee shall assess individual circumstances and have the sole discretion in determining whether or not those conditions are exceptional.

e. Any refunds awarded in respect of this clause will be processed within 45 days of the claim.

f. If a refund is applicable, a credit invoice will be issued. Any refund made by AIT will be paid to the original payor.

g. Notice of cancellation must be sent in writing (via email) to AIT. Verbal notice will not be considered a cancellation.

h. Substitution of participation is possible (as long as the substitute fits the applicable profile), and must also be requested in writing, with the full contact details of the new registrant. AIT must be notified in writing at least 48 hours prior to the start of the program. When a substitution of participation is approved, no refunds will be issued.

i. Some of our courses tuition include a license for Forex Tester software, this is provided by an external software company (ForexTester.com). If this license has been allocated already to the student, and the student applies for a course tuition refund, then we have the right to substract and keep the license price corresponding to the Forex Tester basic version software (approx. 180 Euro, or at market price at that time). 

k. We have a No Refunds policy for our Community Services on Discord Elite channels, Digital products such as our eBooks or Video on demand content on store.[domain] and video.[domain], MEE6.xyz or WHOP.com accounts.
l. In the event of significant technical disruptions caused by AIT that prevent course completion, students may request a proportional refund, which will be evaluated on a case-by-case basis.

7.1 Coaching Terms of Service

Disclaimer: payment for consultations are based on time and time alone. Payment is not based on content or context of said meeting. Client is responsible for any questions asked, etc. to ensure they achieve desired use of time, AIT trainer will strive to provide requested information, but makes no guarantees that a solution will be reached in one scheduled meeting.

m. CANCELLATION & REFUND POLICY for Coaching services

  • If you are in need of rescheduling, please contact me 48 hours (2 days) or more before our meeting. If a full cancellation is required, please contact me 72 hours (3 days) or more before our meeting and allow 24 Hours or more for notification.

  • There will be no refunds provided on scheduled meetings where clients are a no-show. The consultation window (using Teams/GoogleMeet etc) will be open during clients scheduled time frame where the service provider, AIT trainer, will be in attendance. If client is a no-show or has not given a 48 hour notice for re-scheduling or cancellation, then a refund for the 60 minute time frame will not be granted.

  • Client is responsible for paying another consultation session if the initial meeting is missed. The consultation fee is solely based on the time for meeting whether questions get answered or not. Client is paying for the time, not content or context of the meeting.

 

7.2 Other General Conditions

a. AIT reserves the right to deny program admission to an applicant if we deem that they lack the necessary qualifications or experience needed for the particular program.

b. AIT reserves the right to use its discretion to determine whether to make refunds in particular instances which fall outside paragraph 6 above.

c. In the event of unforeseen circumstances, such as a low number of participants, AIT reserves the right to cancel a program. Reimbursement for program fees will be made available in these cases; however AIT cannot take on any financial obligation with regard to travel, accommodation or other costs related to the cancelled program or event, where and if applicable.

d. AIT is committed to providing its participants with excellent service; however, the liability of AIT for losses caused by its negligence, breach of contract, or any other reason will be capped at the full amount(s) paid by participant(s) for relevant program(s) and/or materials.

e. Regarding the upgraded version of products where "[X] Months of Personal Technical & Mindset Guidance" (X=a number) is included, to be understood that it will be capped to a maximum of 1Hour per week of 1-on-1 session, where the Student gets to ask Questions from his/her weekly trading journey and we go through the eventual trading results, homework tasks and mindset points of the Student together.  If no questions are due for discussion from Student's side, then this time can be used by the Student to practice trading and improve his/her trading skills.

f. Site and Service Content are not meant for individuals under the age of 18.

 

7.3 No-Show and Late Cancellation Policy

By booking a complimentary 1:1 session, you agree to commit to showing up on time for the scheduled appointment. If you are unable to attend, you must cancel or reschedule your session with at least 24 hours' notice prior to the appointment time. Failure to provide at least 24 hours' notice of cancellation or rescheduling, or failure to attend the scheduled appointment (a "no-show"), will result in a no-show or late cancellation fee of €50. This fee is intended to cover the costs incurred due to the missed appointment. By proceeding with the booking, you acknowledge and agree to this policy.

 

8. Force majeure

Amsterdam Institute of Trading (AIT) shall not be liable to the student or be deemed to be in breach of its agreement to provide any of their service/products to the student by reason of any delay in performing, or any failure to perform, any of AIT's obligations, if the delay or failure is due to any cause beyond AIT's reasonable control. Causes beyond AIT's reasonable control shall include but are not limited to:

  • the non-availability (including due to sickness, injury, or death) of any person employed or engaged by AIT to deliver the services who cannot by the exercise of reasonable endeavors be replaced or substituted;

  • events or circumstances that cause any premises where the trading course or coaching is to be delivered to be unavailable, if suitable alternative premises cannot by the exercise of reasonable endeavors be found;

  • the course or coaching being terminated prior to its scheduled conclusion (e.g. due to security evacuation, fire evacuation); 

  • failure of power, internet connection, or the student's system in the case of remote delivery of the course or coaching.

  • this also includes pandemics, economic collapses, and geopolitical crises impacting service delivery.

 

In such circumstances, AIT may extend the time for performance of its obligations so affected, and if the cause continues for longer than 30 days or the force majeure is found to be permanent, AIT's agreement (the course, the coaching sessions) with its participants for the relevant program(s) will be terminated without liability to the student.

AIT strictly adheres to its policies and reserves the right to cancel, change, reschedule, relocate or suspend (the execution of) any program in cases of force majeure.

 

 

9. Community Responsibility Clause, Data Protection, Assets created and opinions shared and 

Your enrolment on a course of study requires sharing of personal information about you (including “Sensitive Personal Information”). You give your express permission for the sharing of information for the purposes of managing your application, enrolment, academic achievement, fees management and related activities. All information will be held and processed in accordance with the requirements of the Data Protection Act.

 

By enrolling in a course, you are granting us permission to collect personal information about you (including “Sensitive Personal Information”). You give your express permission to share this data for purposes of managing your application, enrolment, academic progress, fees payment and other related activities of which will be done as per the Data Protection Act guidelines.

Privacy Community Groups such as WhatsApp: Please note that members' phone numbers may be visible to other members for seamless communication within the group. By participating in AIT's WhatsApp, Discord, or other group platforms, users consent to limited visibility of their contact information (e.g., phone number) by other members. AIT is not liable for how this information is used by group participants.

AIT reserves the right to remove participants from community groups (e.g., WhatsApp, Discord) for inappropriate behavior, spamming, or sharing unauthorized third-party materials.

 

 

9.1 Terms and Conditions for The assets created and opinions shared

The assets created and opinions shared are made available for (company) use globally and for perpetuity.

By submitting a review/testimonial on any reviews platform on the world wide web about AIT, you agree that the content created and opinions shared are made available for use by The Institute of Trading (AIT) globally and for perpetuity. This includes the right to publish, distribute, and utilize the review in promotional materials, press releases, and other marketing channels.

Some Live Courses or FREE Webinars sessions where you participate may be recorded and portions and/or the full length of the recording may be used to improve and extend our range of products, to provide an as-close to real learning experience for students such as On Demand (recorded) Video Courses, or to be distributed to students who were unable to participate to the Live session; we are doing our best to protect your full name and face , but they still may pop-up in some recordings, conversations, including your voice. By participating to the Live or Free sessions you confirm that you agree with this. 10. Confidentiality

You shall not, except as authorised by AIT, divulge to any persons, firm, company or other organisation whatsoever at any time any confidential information belonging to AIT or relating to its affairs or dealings which may come to your knowledge during your association with AIT. All papers and digital files, software EAs and templates are considered to be confidential, together with any copies or extracts thereof, made or acquired by you in the course of your time with AIT.

 

 

11. Disclaimers
Earning potential is entirely dependent on the person using our service. We do not purport this as a “get rich scheme.” Your level of success in attaining the results claimed in our materials depends on the time you devote to the program, ideas and techniques mentioned, your finances, knowledge and various skills. Since these factors differ according to individuals, we cannot guarantee your success or income level. We cannot guarantee that you will make any money at all. Nor are we responsible for any of your actions.
 

11.1. Investments

When attempting to apply a discount code to a purchase, the system will automatically determine its eligibility. If a course is already subject to a discount or special pricing, additional discount codes may not be combined or applied to further reduce the course price. We reserve the right to modify or revoke discount codes at any time without prior notice.

11.5 Product Descriptions and Promotional Material 

At the Amsterdam Institute of Trading, we use enthusiastic and motivational language in our product descriptions and promotional materials to illustrate the potential benefits and outcomes of our courses, indicators, and coaching services. Phrases like "Start making profits from tomorrow" , "How to earn up to $35K/Month" , "With trading you will never work again"etc. etc. are designed to highlight the possibilities and the effectiveness of our trading strategies under optimal conditions and following certain steps. 12.3 Educational Use of Test-Net Tokens used during crypto/blockchain educational products / services

Purpose of Tokens
The tokens distributed during the course are created on a test network (test-net) and are intended solely for educational and demonstrative purposes as part of a crypto or blockchain-related educational program. These programs may include, but are not limited to:

  • Live or online courses

  • Coaching sessions

  • Video courses

  • Webinars or workshops

These tokens:

  • Have no economic, financial, or market value.

  • Are used exclusively for simulating transactions and supporting the practical understanding of trading and blockchain concepts taught in the program.

  1. Separation of Course Fees and Tokens

    • The course fee paid by participants covers educational services, including access to course materials, demonstrations, and instructor expertise.

    • The fee does not constitute payment for the acquisition of tokens, and the tokens are not sold, traded, or offered as investment assets.

  2. Non-Investment Nature of Tokens

    • The tokens are not designed, promoted, or intended for investment purposes.

    • They do not confer any financial rights, ownership, or economic benefits to participants.

  3. Prohibition on Selling Tokens

    • Participants are strictly prohibited from selling, trading, or exchanging the tokens for money or any other form of compensation.

    • If a participant engages in such activities, AIT, its partners, collaborators, and affiliates are not liable or responsible for any consequences, including but not limited to financial losses, legal issues, or regulatory actions.

  4. Test-Net Environment

    • All activities involving tokens are conducted in a simulated test-net environment and do not involve real cryptocurrencies or financial risks.

    • Participants acknowledge that all transactions are simulated and agree to use the tokens strictly as guided during the course.

  5. Liability Disclaimer

    • AIT is not responsible for any misinterpretation of the purpose or use of the tokens.

    • Participants agree to use the tokens solely for educational purposes and in accordance with the course guidelines.

  6. Regulatory Compliance

    • The tokens distributed during the course are not classified as "crypto-assets" under the Markets in Crypto-Assets Regulation (MiCA), as they are not intended for economic use, payment, or investment purposes.

    • AIT ensures that the tokens comply with applicable regulations and are used exclusively in an educational context.

13. Intellectual Property Rights

Any unauthorized recording, copying, distribution, or transmission of our courses, whether live or video on demand, will result in a penalty of €500,000 (five hundred thousand euro). Unauthorized use of AIT trademarks, logos, slogans, or proprietary materials will result in legal action, with penalties as determined under Dutch law, including but not limited to fines starting at €500,000 (five hundred thousand euro). This penalty is enforceable in addition to any other legal remedies available to The Institute of Trading under applicable law.

13.1. Site and Service Content, Software and Trademarks

You acknowledge and agree that the Site and Service contain content or features (the “Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorised by us, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Site, Service or Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally upload to the Site or Service.

In connection with your use of the Site and/or Service, you agree that you shall not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods.

If you are blocked by us from accessing the Site or Service (including but not limited to blocking your Internet Protocol (“IP”) address), which may be done at our sole discretion for any reason whatsoever, you agree not to implement any measures to circumvent such blocking (e.g. by masking your IP address or using a proxy IP address). Any use of the Site, Service or Content other than as specifically authorised herein is strictly prohibited.

The technology and software underlying the Site and/or Service or distributed in connection therewith are the property of us, our affiliates and/or our partners (where applicable) (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by us.

The content on the Site and/or Service is protected by applicable copyright and intellectual property laws and is the exclusive property of AIT and/or the respective owners who may or may not endorse or be affiliated with or connected to us. Nothing in these Terms and Conditions, the Site or the Service should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of the content on the Site and/or Service, without our prior written permission in each instance. All goodwill generated from the use of the content on the Site and/or Service will inure to our exclusive benefit.

13.2. Third Party Material

Under no circumstances will we be liable in any way for (a) any content or materials of any third parties (including users), including but not limited to any errors or omissions in any content, or (b) any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that we do not pre-screen content, but we and our designees will have the right (but not the obligation) at our sole discretion to refuse or remove any content that violates these Terms and Conditions or is deemed by us, at our sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

13.3. User Content Transmitted Through the Service

With respect to the content or other materials you upload through the Service or share with other users or recipients (collectively, the “User Content”), you represent and warrant that you own all right, title, interest in and to such User Content, including, without limitation, all copyrights and rights of publicity contained therein, and that you have all required rights to post or transmit such content or other materials without violation of any third-party rights. By uploading any User Content you hereby grant and will grant us, our affiliated companies and partners a non-exclusive, worldwide, royalty free, fully paid up transferable, sub-licensable, perpetual, irrevocable licence to copy, display, upload, adapt, perform, publish, distribute (through multiple tiers of distribution and partnerships), store, modify and otherwise use and fully exploit your User Content in any and all media, form, medium, technology or distribution methods now known or later developed and for any and all purposes (commercial or otherwise).

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information relevant to the Service (“Submissions”), provided by you to us, our affiliated companies or partners are non-confidential and we, our affiliated companies and partners will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.

You acknowledge and agree that we may (but are under no obligation to) preserve content and may also disclose content if required to do so by law or in good faith that such preservation or disclosure is reasonably necessary to:

i. comply with legal process, applicable laws or government requests;
ii. enforce these Terms and Conditions;
iii. (respond to claims that any content violates the rights of third parties; and/or
iv. protect the protect the rights, property, or personal safety of us, our users and/or the public

You understand that the technical processing and transmission of the Service, including your content, may involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Subject to compliance with any applicable personal data protection laws, we reserve the right to publish by any means (including but not limited to the Site) any testimonial(s) provided to us by you in relation to the Site and/or Service.

 

 

14. Disputes Between Users

You agree that you are solely responsible for your interactions with any other user and we will have no liability or responsibility with respect thereto. We reserve the right, but are under no obligation, to become involved in any way with disputes between you and any other user of the Service.

 

15. Non-Competition
You agree to not independently or partneredly advertise, promote, or solicit any business activity that is in competition with the Site and Service. We reserve the right to revoke your access privileges in an event that we determine a breach of this provision was infringed upon. There will be no compensation for any Service purchases in the event of such revocation and termination.

 

16. Regular Updates

AIT Terms and Conditions are subject to change. We communicate changes through updates to our websites. It is advisable to regularly check for updates.

 

17. Legal disputes

If necessary, any legal disputes will be settled under the Dutch law at the Court within The Netherlands.

18. Refer 2 Friends and Earn a Free Course - Program

 

The Institute of Trading (“IoT”) Affiliate and Refer-a-Friend Scheme is a program designed to financially reward individuals who introduce their friends to IoT courses. In order to be eligible for the rewards, all the Terms and Conditions below must be met:

 

18.1. Eligibility:  

The "Refer 2 Friends and Earn a Free Course" program is open to all existing and new students of The Institute of Trading.  

The referred friends must be new students who have not previously enrolled in any course offered by The Institute of Trading.

 

18.2. Enrollment:  

To qualify for the free course, both referred friends must complete their enrollment and payment for the selected course.  

The free course will be granted to the referrer only after the referred friends have fully paid and commenced their course.

 

18.3. Refund Policy:  

The referred friends must commit to their course enrollment and are not eligible for refunds. By participating in this program, referred friends acknowledge and agree to this no-refund policy.  

In the event that a referred friend requests a refund or cancels their enrollment, the referrer will no longer be eligible for the free course unless another friend enrolls and completes the payment.

 

18.4. Form Submission:  

The referrer must fill out the referral form accurately with all required details, including the names and contact information of the two referred friends.  

The form must be submitted within 30 days of the referred friends' enrollment to qualify for the free course.

 

18.5. Free Course Redemption:  

The free course must be claimed within 14 days of notification and must be used within 6 months from the date of issuance.  

The free course is non-transferable and cannot be exchanged for cash or any other value.  

The free course can only be applied to eligible courses as determined by The Institute of Trading. Additional fees for premium content or materials may apply.

 

18.6. General Conditions:  

The Institute of Trading reserves the right to modify, suspend, or terminate the "Refer 2 Friends and Earn a Free Course" program at any time without prior notice.  

The Institute of Trading reserves the right to disqualify any participant who violates these terms and conditions or engages in fraudulent activities, such as referring fake accounts or self-referrals.

 

18.7. Disputes Between Affiliates:  

You agree that you are solely responsible for your interactions with any other affiliates, and The Institute of Trading will have no liability or responsibility with respect thereto.  

The Institute of Trading reserves the right, but is under no obligation, to become involved in any way with disputes between you and any other affiliate of the program.  

Disputes between affiliates will not affect the eligibility of other participants or the operation of the program.

 

19. Institute of Trading Affiliate Program Terms and Conditions

 

19.1. Introduction  

Welcome to the Institute of Trading Affiliate Program (the "Program"). These terms and conditions (the "Terms") govern your participation in the Program. By signing up for the Program, you agree to abide by these Terms.

 

19.2. Joining the Program  

19.2.1 Eligibility:  

To join the Program, you must be at least 18 years old. We reserve the right to accept or reject any affiliate application at our discretion.  

 

19.2.2 Sign-Up:  

Joining the Program is free and easy. Simply sign up at the Institute of Trading Affiliate Program to get started.

 

19.3. Affiliate Responsibilities  

19.3.1 Promotion:  

Affiliates are allowed to promote our products through various channels, including websites, social media, blogs, and more. Affiliates are responsible for ensuring that all marketing materials used comply with applicable laws and regulations. Affiliates engaging in fraudulent activity, including false advertising, misrepresentation of IoT services, or spamming, will be disqualified immediately, with commissions forfeited.  

 

19.3.2 Prohibited Activities:  

Affiliates are prohibited from engaging in any deceptive, misleading, or unethical practices, including but not limited to spamming, false advertising, and using unauthorized promotional codes.  

 

19.3.3 Affiliate Links:  

Affiliates must use the unique tracking links provided by the affiliation marketing platform (for example, GoAffPro). These links track customer referrals and ensure you receive credit for qualifying purchases.

 

19.4. Commission Structure  

19.4.1 Commission Rates:  

Affiliates can earn up to 25% commission on qualifying purchases made through their affiliate links. The exact commission rate may vary depending on the product and any promotional campaigns.  

 

19.4.2 Referral Discount:  

In addition to earning commissions, the referrer is also eligible to receive a discount on their own purchases. The current discount rate is 10%, but this rate may change at any time at the discretion of the Institute of Trading. Affiliates may contact us to request the 10% discount for their purchases.  

 

19.4.3 Qualifying Purchases:  

A "qualifying purchase" is a purchase made by a referred customer that meets the following criteria:  

- The purchase was made using the affiliate’s unique tracking link.  

- The purchase was not refunded, canceled, or charged back.  

- The purchase is not for the affiliate self.  

- The referred customer is not an existing member of the IoT community, a former client, or a webinar participant at the time of purchase, unless the purchase is made directly through the affiliate’s unique tracking link.  

 

19.4.4 Payouts:  

Commissions are paid out on a monthly basis, provided the affiliate has met the minimum payout threshold of €50. If the threshold is not met, commissions will be rolled over to the next month. Affiliates are responsible for providing accurate payment information.  

 

19.4.5 Cookie Duration:  

Affiliate cookies will be valid for 30 days from the time a potential customer clicks the affiliate’s unique tracking link. Purchases made after this period will not be attributed to the affiliate unless the customer clicks the affiliate link again.  

This policy encourages affiliates to remain active in promoting and building their client base.  

 

19.4.6 Memberships and 1:1 Coaching Commissions:  

For memberships and 1:1 coaching services, affiliates are eligible for a 10% commission if they can demonstrate a direct influence on the purchase. This includes private conversations or referrals that lead to the sale. The transaction must still be recorded through the affiliate’s unique tracking link or verified by the Institute of Trading.

 

19.5. Termination  

19.5.1 Termination by Affiliate:  

Affiliates may terminate their participation in the Program at any time by providing written notice to the Institute of Trading.  

 

19.5.2 Termination by Institute of Trading:  

We reserve the right to terminate any affiliate's participation in the Program at our discretion, without notice, if the affiliate is found to be in violation of these Terms.  

 

19.5.3 Effect of Termination:  

Upon termination, the affiliate will no longer have access to the Program, and any outstanding commissions will be forfeited if termination was due to a breach of these Terms.

 

19.6. Intellectual Property  

19.6.1 License:  

Affiliates are granted a non-exclusive, revocable license to use our trademarks, logos, and other branding materials for the sole purpose of promoting our products as part of the Program.  

 

19.6.2 Restrictions:  

Affiliates may not modify our trademarks, logos, or other branding materials in any way without prior written consent from the Institute of Trading.

 

19.7. Limitation of Liability  

The Institute of Trading will not be liable for any indirect, incidental, or consequential damages, including loss of profits, arising from your participation in the Program, even if we have been advised of the possibility of such damages.

 

19.8. Amendments  

We reserve the right to update or modify these Terms at any time, with or without notice. It is your responsibility to review these Terms periodically to ensure compliance.  

Continued participation in the Program after any changes to these Terms constitutes your acceptance of the updated Terms.

 

19.9. Governing Law  

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles.

19.11. Disputes and Exceptions  

Affiliates are not entitled to commissions for purchases made by customers who were already part of the IoT community, including but not limited to:  

- Existing members.  

- Former clients.  

- Webinar participants.  

An exception applies if the purchase is made directly through the affiliate’s unique tracking link.  

 

Any disputes regarding commissions must be submitted in writing within 30 days of the sale.  

The Institute of Trading reserves the right to verify and validate all claims to ensure compliance with these terms. The final decision on all disputes will be made at the sole discretion of the Institute of Trading.

 

19.12. Final Reminder  

By participating in the Program, you agree to these Terms. The Institute of Trading reserves the right to update or modify these Terms at any time, with or without notice. It is your responsibility to review these Terms periodically to ensure compliance.

20 Loyalty Points Program Terms

20.1 Eligibility and Redemption:
Loyalty points can only be redeemed during the checkout process when enrolling in one of our live courses.
Points cannot be redeemed for any other products, services, or offers unless explicitly stated.

 

20.2 Non-Transferable and Non-Exchangeable:
Loyalty points are non-transferable and cannot be exchanged for cash, fiat currency, or any other form of monetary value.
Points have no cash value and are solely intended for use within the scope of the loyalty program.

20.3 Expiration and Limitations:
Points may expire after a certain period if not redeemed (optional, if you have an expiration policy).
The company reserves the right to modify or terminate the loyalty program at any time without prior notice.

20.4 Fraud and Abuse:
Any misuse of the loyalty program, including attempts to exchange points for cash or transfer them to another user, may result in the forfeiture of points and/or account suspension.

 

 

ADDITIONAL TERMS AND CONDITIONS FOR IN-PERSON EVENTS
(Applicable to 'Amsterdam Trading Breakthrough Workshop' and all Institute of Trading In-Person Events)

21.1 EVENT ENGAGEMENT:
Thank you for registering for The Institute of Trading's In-Person Event. We are pleased to offer you this seminar service.

21.2. EVENT TIME, PLACE, AND FORMAT:
Upon payment of the agreed Investment Sum, you are entitled to:

(a) Attend the In-Person Event.
(b) Receive any Materials and/or bonuses explicitly included with your purchase, as detailed on our website and in your purchase confirmation email.
(c) The Institute of Trading reserves the right to modify the Event Speakers, schedule (hours), or dates due to unforeseen circumstances.  We will notify you in writing of any such changes, including details of substitute speakers, revised hours, and/or new dates. Any changes will not substantially alter the core content of the In-Person Event.

In the event of such changes:
(i) The Institute of Trading shall not be liable to you for any costs, expenses, or losses incurred as a result of these changes.
(ii) You agree that you shall not make any claims against The Institute of Trading (including for refunds beyond what is outlined in the Refund Policy) due to such modifications.

21.3. INVESTMENT AND PAYMENT:
(a) In consideration for attending the In-Person Event, you agree to pay The Institute of Trading the Investment Sum in full upon placing your order, unless an installment plan is offered and selected.  Payment must be made without set-off, deduction, or counterclaim.
(b) The Institute of Trading reserves the right to refuse admission to the In-Person Event and cancel your order if full payment is not received by the Event start date.

21.4. ATTENDEE DETAILS:
(a) To ensure proper event registration and communication, The Institute of Trading requires the following details for each attendee to be provided no later than 21 days before the In-Person Event start date:
    *   Full Name
    *   Contact Phone Number
    *   Email Address
    *   Postal Address
(b) It is the sole responsibility of the purchaser to provide accurate and complete attendee details as outlined in clause 4(a) at least 21 days prior to the Event start date. Once submitted, attendee details generally cannot be updated.
(c) Each attendee must provide a unique email address and contact number to register for and attend the In-Person Event. While initial attendee details are generally fixed,  update requests may be considered if submitted via the update link in your purchase confirmation email or by emailing support@instituteoftrading.net with complete and corrected information. It remains the purchaser's responsibility to ensure all attendee details are accurate.
(d)  Event access is contingent upon registering all attendees using the registration link provided at the time of your purchase and adhering to the requirements of clause 4(a).  Failure to register attendee details at least 21 days prior to the In-Person Event start date may result in denial of Event access.

21.5. TICKET TRANSFER RESTRICTIONS:
Tickets for the In-Person Event are non-transferable to alternative In-Person Events, or any other products or services offered by The Institute of Trading. If you are unable to attend the In-Person Event for which you purchased a ticket, your ticket will be forfeited, subject to the Refund Policy outlined below.

21.6. EVENT CANCELLATION AND POSTPONEMENT:
(a) Cancellation by The Institute of Trading: The Institute of Trading reserves the right to cancel the In-Person Event for any reason. In the event of a cancellation, we will make reasonable efforts to notify you using the contact details provided at the time of booking. You will receive a refund of the Investment Sum actually paid, less a reasonable administration fee (as determined by The Institute of Trading), within 30 days of cancellation notification.
(b) Postponement or Rescheduling: The Institute of Trading may reschedule or postpone the In-Person Event due to unforeseen circumstances.  In such cases, we will use reasonable efforts to offer you a ticket to the rescheduled Event of equivalent value to your original Investment Sum.  Any portions of the In-Person Event already delivered to you prior to postponement (e.g., pre-event materials) are non-refundable.  Events that are rescheduled or postponed are not eligible for refunds, except in cases of cancellation as per clause 6(a).

21.7. DISCLAIMERS AND DISCLOSURES:
You acknowledge and agree that:

(a) No Investment Advice: Neither The Institute of Trading, its representatives, nor any individuals engaged to deliver the In-Person Event ("Relevant Persons") are registered investment advisors or authorized by any governmental or regulatory body to provide investment advice.
(b) Educational Purposes Only: The In-Person Event and Relevant Persons are providing education and training on trading and investing strategies for educational purposes only, and do not purport to offer personalized investment advice or operate as an investment advisory service.
(c) Third-Party Commissions: The Institute of Trading may provide compensation, including commissions, to third parties in connection with your purchase of the In-Person Event ticket or related products and services.

21.8. TICKET SALE AND RESALE POLICY:
(a) Resale Prohibition:  Re-advertisement or offering for resale of tickets to the In-Person Event is strictly prohibited.
(b) Consequences of Resale: If a ticket to the In-Person Event is found to be offered or advertised for resale, The Institute of Trading reserves the right to:
    *   Cancel the original purchaser's ticket and deny event access without refund.
    *   Refuse entry to any individual attempting to use a resold ticket.
(c) Ticket Name Changes (If Applicable): In cases of unauthorized ticket resale attempts, the original purchaser may forfeit any right to change the name on the ticket, even if name changes are generally permitted for the Event.

21.9. FORCE MAJEURE:
The Institute of Trading shall not be liable for failure to perform its obligations under this Agreement if such failure is caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, fire, power outages, floods, pandemics, epidemics, civil unrest, strikes, lockouts, or governmental regulations ("Force Majeure Events"). In the event of a Force Majeure Event preventing or causing cancellation of the In-Person Event, The Institute of Trading may, at its sole discretion:

(a) Postpone the In-Person Event to a future date.
(b) Cancel the In-Person Event and provide refunds in accordance with clause 6 (Event Cancellation and Postponement).

21.10. GENERAL PROVISIONS:

(a) Notices and Communication: All official notices and communications related to the In-Person Event must be directed to support@instituteoftrading.net.
(b) No Waiver: Failure or delay by The Institute of Trading to exercise any right or power under these Terms and Conditions shall not operate as a waiver of such right or power. Any waiver of any provision herein must be in writing and signed by an authorized representative of The Institute of Trading.
(c) Mature Audience: The In-Person Event is intended for a mature audience. Individuals under the age of 13 are not permitted to attend.
(d) Event Language:  The primary language of the In-Person Event is English.  Translation services may be available upon request; please contact support@instituteoftrading.net for inquiries and availability.
(e) Speaker Appearances: Advertised speakers will participate at various times throughout the In-Person Event and may not be present for the entire duration of the Event.
(f) Order and Attendee Communication:  For each order, a single invoice will be generated, and initial communication will be exclusively with the original purchaser.  Communication regarding specific attendees will commence once attendee details are provided as per clause 4.
(g) Live Event - No Recording: The In-Person Event is a live, interactive event.  No recordings of the Event will be made available to attendees.
(h) Registration Link Delivery:  A registration link for the In-Person Event will be sent to the registered attendee email address(es) approximately 21 to 5 days prior to the Event start date.  The Institute of Trading's obligation to provide Event access is deemed fulfilled upon successful transmission of this registration link to the provided email address(es).

21.11. CONFIDENTIALITY AND NON-DISCLOSURE:
(a) Confidential Information: You acknowledge that you will be exposed to information and materials during the In-Person Event that are considered confidential and proprietary "trade secrets" of The Institute of Trading.
(b) Non-Disclosure Obligation: You agree to hold all such confidential information in strict confidence and not disclose, reproduce, or distribute any training techniques, methodologies, seminar content, or any other proprietary information shared during the In-Person Event to any third party, whether through online forums, message boards, social media, private communications, blogs, or any other channels.
(c) Breach of Confidentiality:  Disclosing confidential information in violation of this clause will constitute a material breach of these Terms and Conditions, and may subject you to legal action and liability for damages incurred by The Institute of Trading.
(d) Prohibition of Derivative Works: You further agree not to create, participate in the creation of, or partner with any individual or entity to create any derivative products or services based on The Institute of Trading's confidential information or In-Person Event content, including but not limited to e-books, reports, audio or video recordings, online content, or any other derivative materials, without express written consent from The Institute of Trading.  Recording any portion of the In-Person Event is strictly forbidden.
(e) Indemnification:  You agree to indemnify and hold harmless The Institute of Trading, its speakers, associates, affiliates, and representatives from any and all losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to any breach of this Clause 11 by you.

21.12. REFUND AND CANCELLATION POLICY:

(a) 14-Day Cooling-Off Period:  You are granted a 14-day "cooling-off" period, commencing on the date of your In-Person Event purchase.  During this cooling-off period, you may request a full refund of your Investment Sum, for any reason, by providing written notice to support@instituteoftrading.net. This cooling-off period is provided to allow you sufficient time to evaluate the suitability of the In-Person Event for your needs.
(b) Refunds After Cooling-Off Period:  After the 14-day cooling-off period expires, NO REFUNDS will be issued under any circumstances, except in cases of Event cancellation by The Institute of Trading as per clause 6(a). We will not consider or process any refund requests received after the cooling-off period.
(c) Enrollment Transfers (Subject to Availability):  If you are unable to attend the In-Person Event and wish to inquire about transferring your enrollment to a different date (if available), you may submit a transfer request to support@instituteoftrading.net. Transfers are subject to approval by The Institute of Trading and may incur additional transfer fees.  Ticket transfers as outlined in Clause 5 are not permitted.
(d) No-Show Policy:  Failure to attend the In-Person Event without providing prior written notice of cancellation to support@instituteoftrading.net before the event start date will result in the complete forfeiture of your Investment Sum. No refunds or credits will be issued for no-shows.

Acknowledgement: By registering for the In-Person Event, you explicitly acknowledge that you have carefully read, fully understood, and unequivocally agree to be bound by the terms of this Refund and Cancellation Policy. This policy is established to ensure the efficient administration and integrity of our In-Person Events while respecting the needs of our participants.

Review and Questions: Please carefully review this Refund and Cancellation Policy before completing your In-Person Event registration. Should you have any questions or require clarification regarding this policy, please do not hesitate to contact our customer support team at support@instituteoftrading.net.


 

22. Two-Payment Term Plan for Wealth Builders Club (1 Year) and Live Trading Course

22.1 Payment Schedule: The total price for the Wealth Builders Club 1-Year membership and Live Trading Course is payable in two installments, as specified at the time of purchase. Term 1 is due upon purchase, and Term 2 is due  4 weeks after the Term 1 payment. Specific payment instructions and due dates for Term 2 will be provided after the successful processing of Term 1.

​22.2 Live Trading Course: Scheduling for the Live Trading Course will be confirmed after the successful payment of Term 2. You will be contacted to arrange a date that works for you.
Wealth Builders Club: Access to the Wealth Builders Club online platform and resources will be granted immediately following the successful payment of Term 1.

22.3 Payment Default: Failure to pay Term 2 within 5 days of the due date may result in the suspension or termination of your Wealth Builders Club membership and forfeiture of access to the Live Trading Course. We reserve the right to pursue collection of outstanding payments.
